Unmarried spouse and spousal visas

If you have a long-term partner with a British passport or right of abode, you could be able to get a long-term UK visa too. Your partner must have settled status in the UK, which Tier 1 (highly-skilled) and Tier 2 (work permit) visas don’t count. In most cases you can then apply for what is called further leave to remain (FLR), which is granted for two years—after that, you’re able to apply for indefinite leave to remain (ILR). It can be a bit trickier if you aren’t married yet, so it’s important to know the distinctions:

1.    If you’re together, but not married
•    You need to prove to the Home Office that your relationship is similar to marriage, so bring any bank statements, lease agreements, rent receipts, letters, birthday and Christmas cards –any scrap of evidence that links you and your partner
•    These documents must cover a two year span and must be originals

2.    If you’re married
•    You can apply for FLR (with all the same evidence requirements as above, plus proof of your marriage.)
•    If you are overseas when you marry a Brit, you must enter the UK on FLR on the basis of marriage.
